Coinbase Disclosure Documents Show New York Attorney General Asked SEC to Classify ETH as Securities "
Internet reports that Coinbase recently obtained and disclosed a batch of internal communications documents from the U.S. Securities and Exchange Commission (SEC) through the Freedom of Information Act (FOIA), which showed that the New York State Attorney General's Office requested the U.S. SEC to explicitly recognize Ethereum (ETH) as a securities during its lawsuit against KuCoin in 2023. Shamiso Maswoswe, director of the Investor Protection Bureau of New York, said in a letter that he hoped the US SEC would submit an amicus curiae opinion to support the view that ETH is a securities to strengthen investor protection. However, the US SEC ultimately did not accept the request, but the document revealed internal discussions among regulators on the characterization of ETH, especially after Ethereum moved to a PoS consensus mechanism. Coinbase said the disclosure aims to improve regulatory transparency and promote public understanding of crypto asset regulatory policies.
