Texas judge rules that Tornado Cash cannot be sanctioned again
Internet reported that the U.S. District Court for the Western District of Texas issued a final ruling, finding that the Treasury Department's Office of Foreign Assets Control (OFAC) sanctions on Tornado Cash were illegal and permanently prohibited it from imposing sanctions on the currency mixer. This marks the conclusion of a two-year legal dispute that has finally been won by the privacy agreement. Court documents show that although OFAC voluntarily removed Tornado Cash from the sanctions list in March 2024, Judge Robert Pitman pointed out that it reserved the intention to re-impose sanctions in the future and emphasized that "the Fifth Circuit Court of Appeals ruling requires enforcement." Six plaintiff lawyers in this case accused OFAC of trying to evade judicial review through technical operations. It is worth noting that two Tornado Cash developers Roman Storm and Roman Semenov still face criminal charges from the U.S. Department of Justice, which is still on the OFAC sanctions list. The ruling only dealt with the agreement itself and did not involve judicial proceedings against the developers.
