The judge overseeing the multibillion-dollar class-action lawsuit against GitHub, OpenAI and Microsoft has partially dismissed charges against the defendants over the alleged unauthorized use of intellectual property (IP) to train "GitHub Copilot" artificial intelligence (AI) coding software.。This marks a victory for big tech companies and the generative AI industry, which is currently facing multiple related lawsuits.。The plaintiffs in the suit allege that OpenAI "copied" GitHub and used human-written code snippets to train GitHub Copilot without permission, payment, or source.。According to the lawsuit, Copilot copied the manually written code line by line, so the plaintiffs are apparently seeking $1 billion in damages.。There are five anonymous complainants in the case, ostensibly representing class-action lawsuits, and each has been labeled "John Doe" in court documents released to the public so far.。
