During the U.S. government shutdown, the SEC failed to make a decision on the Canary Spot LTC ETF."

Online reported that the U.S. Securities and Exchange Commission failed to take any action on Thursday, its initial deadline for making a decision, leaving Canary Capital's spot Litecoin exchange-traded fund in trouble. The U.S. Securities and Exchange Commission's silence has left the crypto community uncertain how the regulator will operate during the federal shutdown and how its new common listing standards will affect the timeline of dozens of crypto ETF applications pending approval. Bloomberg ETF analyst James Seyffart and FOX News reporter Eleanor Terrett pointed out that the old 19b-4 deadlines for crypto ETF applications may no longer apply because the U.S. Securities and Exchange Commission (SEC) has required applicants to withdraw these deadlines, leaving only the S-1 registration statement as the only document requiring regulatory approval. In August, the U.S. Securities and Exchange Commission (SEC) issued an "action plan" in response to the government shutdown, saying it would "no longer review and approve registration applications." This includes new financial products, changes to rules of self-regulatory organizations, and reviews or accelerated entry into force of registration statements. It is unclear whether the U.S. Securities and Exchange Commission's silence on Canary's spot Litecoin ETF is entirely due to the government shutdown or is also a result of new common listing standards, which will make the 19b-4 deadline irrelevant. Canary withdrew its 19b-4 application on September 25 at the request of the Securities and Exchange Commission, which may have been a factor in the SEC's failure to make a decision on Thursday. It is unclear what impact the 19b-4 petition will have on applicants who have not yet withdrawn the document.
